Refunds & Cancellations

This Refund and Cancellation Policy is subject to change at any time. The published version at the time of the request will be the version used to determine your refund eligibility.

Requests for refunds must be made in writing and can be submitted to: hello@hyawellness.co.nz
Requests must include the name provided, a detailed account giving the reason for the withdraw, and why the refund should be issued.
ADMIN FEE: An administration fee of 15% of the full, and is counted, program cost, will apply to all refunds. There are no exceptions.
If a student has enrolled in a course but has not entered the course, and the period between enrollment and notification of withdrawal does not exceed 14 days from the enrollment date, a refund will be issued for the full amount of the course fee, less the Admin Fee. If you choose to cancel within this period you will receive a refund of the price within 30 days if you are eligible for refunds.
PAYMENT PLANS: If tuition is being paid via a PAYMENT PLAN, then enrollment in all courses covered by the payment plan are subject to the same terms as if tuition is paid for in full and in advance. For these purposes, Tuition is considered to have been received by THE COMPANY upon signing of the payment plan agreement.
TECHNICAL ISSUES: Refunds are not available for students who have experienced technical issues. Although we work hard to do everything possible to avoid issues, many aspects of the technology fall outside of our control such as hosting and server functionality.
Once any online materials, membership access to any Facebook Groups (or others), access to Intellectual Property belonging to Hya Wellness, or links to such materials have been delivered to the student physically or electronically, there shall be no refund applicable.
TRAINING TRANSFERS from one training to another may be permissible as may be postponements of attendance for personal reasons, such as relocation, change in family circumstances, or other factors deemed approvable by the Course Trainers and the Administration. These shall be evaluated on a case-by-case basis, and in any event entry into a new class must be within 6 months of the last date of attendance.
DISCOUNTED COURSES. No refund will be provided on discounted courses or payments that have been made with discount codes at the time of purchase.
IN-PERSON SESSIONS: Refunds will be granted (minus fees) automatically if 72+ hours’ notice is given without any reason to do so. No refund will occur if the participant 1) Turns up late, 2) Cannot find the location of the event on time, or 3) Calls in sick within 72 hours of the event. Refunds will be granted on a case-by-case basis for all other reasons.

Covid Policy & Refunds

We suggest bringing your own yoga mat and equipment if this is an issue.

Please note that due to the impact of Covid-19, we are unable to offer refunds.

In the unlikely event that we must cancel the session, we will refund the full amount, excluding any currency exchange and bank platform fees incurred.

Waiver of liability and hold harmless

As one of the conditions of my participation, specifically release Hya Wellness Limited, its students, agents and employees from any claims or liabilities of any kind whatsoever, arising from or related to my participation in its activities, including accidents, medical, personal, etc.

Mental Health Acknowledgment and Responsibility

I recognise the importance of good mental health for my safe participation in Hya Wellness activities. I hereby pledge to promptly notify Hya Wellness Limited of any issues or concerns with my mental health that might affect my participation. I further understand and agree that I am solely responsible for consulting with my own therapists, doctors, or other healthcare professionals regarding my mental health and that Hya Wellness Limited is not responsible for providing or ensuring such consultation or support.

Photo Release

I agree to grant to A Hya Wellness Limited and its authorised representatives permission to record photography, film and/or video, pictures of my participation. I further agree that any or all of the material photographed may be used, in any form, as part of any future publications, brochure, or other printed, digital or online materials used to promote Hya Wellness Limited and further that such use shall be without payment of fees, royalties, special credit or other compensation.

I agree that I have the right to ask for images of myself not to be used, but will be determined on a case-by-case basis.

Release & Waiver

For the purposes of this Release and Waiver, the term “Releasees” shall refer to any or all of:

1. Name of Practitioners: Michael Skilbeck or Tiarna Sellars
2. Name of organisation, company or legal entity: Hya Wellness Limited
3. The heirs, assigns, successors, employees, volunteers and/or associates of Michael Skilbeck or Tiarna Sellars and/or Hya Wellness Limited.

I (“the Releasor”), understand and acknowledge that the discussions, consultations and Hya Wellness session(s) I have, the Releasees:

a) are not intended to replace any relationship I have with my medical doctor and/or primary health care provider(s);
b) are not intended to constitute medical advice or any substitution for medical care;
c) are not intended to be relied on for prescriptions, recommendations, diagnosis or treatment in relation to any health problem or disease;

I understand that if I am taking any medications or have any medical conditions such as, but not being limited to: schizophrenia, bipolar, epilepsy, heart conditions, or pregnancy, I must advise the facilitator/s. I also understand that even though I have been accepted as a participant, I am responsible for any consequence resulting from the Hya Wellness Session.

I certify that I have consulted a health professional regarding any condition physical, mental or emotional that could interfere with my judgment, or affect my health in any way during or after the Hya Wellness Session. I understand and acknowledge that I am responsible for consulting my health care provider or doctor in case I have or suspect to be suffering from a health problem.

I understand the stories or testimonials presented before or during the session do not constitute a warranty, guarantee, or prediction regarding my experience during or after the session. The Hya Wellness facilitators make no warranty, guarantee, or prediction that I will experience any particular state of awareness or consciousness during or after The Session, nor does it make any representation that I will experience any particular outcome on an issue. In the instance of a group process, I may voluntarily reveal personal information, in doing so I understand that and hereby waive my rights of privacy and confidentiality.

I further understand that my participation in The Session is not intended to create nor does it establish a client-practitioner relationship or any other type of therapeutic or professional relationship between me and Hya Wellness facilitators.

I understand that the Hya Wellness Session could include a physical touch designed to support me in my path and that I have the right to refuse this contact by using the word “stop”.

I understand and acknowledge that by participating in the Hya Wellness Session, I do it at my own risk. It is with this understanding that I voluntarily sign this waiver by agreeing to said terms & conditions. Since the Session is experiential and the extent of the Session’s risks and benefits are not fully known, I agree to assume and accept full complete responsibility for any known and unknown risks associated with my participation in the Session, including any physical injury, psychological or emotional effects, death, loss, or property damage.

I agree and understand the Session may be filmed, photographed and/or recorded and that the Hya Wellness facilitators shall have all rights in and to such film, photographs and/or recording, including the copyright therein. The copyright shall include, but not be limited to, the right to use, re-use, publish, and re-publish and otherwise reproduce, modify, and display any such film, photograph and/or recording for educational and promotional purposes, including without limitation, audiotapes, audio CDs, DVDs, websites, video, or film or any other form of recorded images. I grant the the Hya Wellness facilitators the right, without compensation to myself, to film, photograph and/or record you while participating in the Session and I waive any right which I now have or may have hereafter in any such film, photograph and/or recording. I agree to not record by audio, video, photographic or any other means, any portion of the Session.

In my personal name, that of my heirs and assignees, I exonerate and totally and indefinitely release the relinquishers of any suit, complaint, declaration, damage, cost and/or expense of any kind (that any such prosecution, complaint, declaration, damage, cost and/or expense is caused by the passive or active negligence of the Releasees or otherwise) in connection resulting from any discussion, consultation and/or Session I had.
